Secretary’s Report: Monday, 15 January 2007
Membership:
Taking into consideration non-renewals, membership remains at 84.
33 of our members have taken advantage of our 4 year discounted renewal package. Shame about the rest!! As this represents superb value for money.
Correspondence:
Paperwork, has again, been kept to a minimum this year. Thus allowing for a reduced number of meetings involving our busy committee members, but still allowing us to continue our standard of commitment to our members. Could I please request that all members return paperwork promptly in future, and not wait for reminders!
Insurance:
Members will be pleased to know this year’s claims experience has been yet again relatively low. Our insurance brokers are here tonight, to answer any questions you may have, and we would like to thank them for their continued support, and their kind contribution towards tonight’s events.

Chairmans Report AGM 2007 |
Chairman’s Report: 15 January 2007.
Firstly, may I thank you all for attending our annual dinner, at The Limes Hotel, Needham Market.
The Association has had a quiet year, as last year we decided to keep paperwork to a minimum, and we hope this has not had a detrimental effect on the membership. Members have contacted me during the year with problems, and I have made best efforts to ease their situations, where possible. I will of course continue with this role, of help and advice.
I am invited to various committees with Ipswich Borough Council, representing the IDLA, and will continue to do so this year.
Our website is running, with regular updates, at www.idla.co.uk, this gives more information and advice on a wide range of topics related to our business.
Would all members with email addresses please advice us of said address, as correspondence via email is still our objective!
The executive committee stands at 6, and we hope you have appreciated our efforts during the past year!!

New Tenancy Deposit Providers Announced |
New Tenancy Deposit Providers Announced
After considerable delay, the government have finally publicised the successful bidders for the two types of Tenancy Deposit Protection schemes.
The first type of scheme, a custodial one where the deposit is physically held by the scheme provider, has been awarded to Computershare Investor Services Plc. They are a large company based out of Australia who provides a range of investor and banking services through 10,000 employees in 21 countries. Most significantly, they have, for the last 8 years, run the Australian custodial deposit scheme, giving them significant relevant experience. They have partnered with The Chartered Institute of Arbitrators, who will handle the dispute resolution side of the scheme, leaving Computershare Investor Services Plc to deal with the physical money handling side. It was only ever intended to have one custodial scheme and there were two unsuccessful bidders.
The second type of scheme, and here the government were happy to have one or more schemes, has resulted in contracts being awarded to two parties to run schemes. The first such scheme will be run by The Dispute Service and will primarily target agents. The Dispute Service is owned by RICS (Royal Institute of Chartered Surveyors), ARLA (Association of Residential Letting Agents), and NAEA (National Association of Estate Agents). The second scheme to be awarded a contract for an insurance scheme is Tenancy Deposit Solutions Ltd which is a joint venture between NLA (National Landlords Association), Hamilton Fraser Insurance and The Chartered Institute of Arbitrators.
With both insurance based schemes, the agent or landlord will still hold the deposit, but in the event that they do not refund when they should the insurance will pay the deposit back to the tenant and recover it from the defaulting landlord or agent.
The details of all the schemes are due to be announced in the New Year with the proposed starting date still being quoted as April 2007.
There will be no fees for the custodial scheme, the costs of the scheme administration and the dispute resolution being paid out of the interest generated by investing the deposit money held under the scheme.

Possession Claims Online |
PCOL – Possession Claims Online starts national rollout
The Possession Claim Online Project (PCOL) has just announced its national rollout starting 30th October 2006. The new web-based system will enable landlords and agents to manage claims in county courts for possession of residential property.
BACKGROUND
From June 2006 it has been possible for landlords to start possession actions against their tenants using an electronic online service instead of the traditional paper form-based process. The Possession Claim Online Project (PCOL) provides a web-enabled application to initiate and manage claims in county courts for possession of residential property where there has been non-payment of rent or mortgage.
PCOL will commence national deployment to all civil courts within England and Wales from 30 th October 2006.
FEATURES
PCOL allows a landlord to begin a possession action against a defaulting tenant using an on-line system without having to apply to the local court to obtain and file the required paperwork. The various court forms are provided online, and the possession action is all handled electronically.
The PCOL system also provides the following facilities:
the ability to pay court fees electronically by credit or debit card and by direct debit in the case of bulk users such as Registered Social Landlords, local authorities or firms of solicitors specialising in possession actions
the ability to determine the correct court of issue based on the postcode of the property
the ability to automatically allocate hearing dates on issue of the possession claim
production and despatch of the claim pack to the defendant from a central point for claims received electronically
the ability for defendants to access the system, if they so wish, by a unique password and ID produced by the system
the ability for parties to conduct some other case related processes electronically, for example, issue warrants, make general applications
LIMITATIONS:
At present it will not be possible to use this process for the Accelerated Possession Procedure (APP) or possession actions of assured shorthold tenancies based on section 21 notices. Although it is ultimately envisaged that these types of possession actions will eventually be incorporated within the PCOL system, landlords are currently required to start such possession actions using the current paper-based process.
